A BILL making a supplementary appropriation of public moneys out of the treasury from the balance of moneys remaining as an unappropriated surplus balance in the lottery net profits fund, to the department of education and the arts, educational broadcasting authority, account no. fund 3586, fiscal year 1997, organization 0439, all supplementing and amending the appropriation for the fiscal year ending the thirtieth day of June, one thousand nine hundred ninety- seven.

Whereas, The governor submitted to the Legislature the executive budget document, dated the twelfth day of February, one thousand nine hundred ninety-seven, which included a statement of the lottery net profits fund, setting forth therein the cash balance and investments as of the first day of July, one thousand nine hundred ninety-six, and further included the estimate of revenues for the fiscal year ending the thirtieth day of June, one thousand nine hundred ninety-seven, less net appropriation balances forwarded and regular appropriations for the fiscal year ending the thirtieth day of June, one thousand nine hundred ninety-seven; and
Whereas, It thus appearing from the governor's executive budget document there now remains an unappropriated surplus balance in the state treasury which is available for appropriation during the fiscal year ending the thirtieth day of June, one thousand nine hundred ninety-seven; therefore
Be it enacted by the Legislature of West Virginia:
That chapter eight, acts of the Legislature, regular session, one thousand nine hundred ninety-six, known as the b"Budget Bbill", be supplemented and amended by adding to Ttitle two thereof, a new section, designated section eight-a, as follows:

Any unexpended balance remaining in the appropriation for capital improvements-600 Capitol Street-total-surplus (fund 3586, activity 723) at the close of the fiscal year ending the thirtieth day of June, one thousand nine hundred ninety-seven, is hereby reappropriated for expenditure during the fiscal year ending the thirtieth day of June, one thousand nine hundred ninety-eight.
The purpose of this bill is to supplement the budget act for the fiscal year ending the thirtieth day of June, one thousand nine hundred ninety-seven, by providing for a new item of appropriation to be established therein to appropriate lottery net profit surplus funds available in the fiscal year ending the thirtieth day of June, one thousand nine hundred ninety-seven, to provide funding in the amount of one million two hundred thousand dollars for the capital improvements at 600 Capitol Street.
